This seem like an absurd question, but here it is, and it has two parts:
1. Could a MS v.3 license be considered one of the active licenses for MS v.4? (Ex. We have two machines with MS v.4 installed, and an old laptop with MS v.3. Could the laptop be the 3rd license in use? (I am trying to find the 3rd license..))
2. Is it possible to accidentally have MS v.4 licensed more than once on a machine?

Great questions.
1) V4 will not consider a v3 installation as part of it's allocated licenses. (We do request that users consider the total number of installs (of both versions) as part of their 'alloted' uses. In your case, I'd say you're using 3/3 licenses. :)
2) While rare, if a significant change has occurred on a computer, or the software was upgraded from a very early version of 4.0, MediaShout will be licensed 2x on the same machine. -

Thanks Nathaniel. Yeah, we're not using the v3 on the laptop. In fact, the laptop is destroyed (and I did uninstall MS before it got canned, but I didn't know if that deactivated the license). But I was wondering if that would cause a problem with the v4 licensing. It sounds like it would not.
Is there a way I could check a machine to see if it is carrying two v4 licenses? -
